Cholderton man found guilty of child sex abuse

An amateur radio enthusiast and “pillar of the community” has been found guilty on multiple counts of historic child sex abuse.

John Terence Cull, commonly known as Terry, was found guilty on 18 counts of rape and sexual assault of a girl over a 15-year period in the 1970s and 1980s.

The 77-year-old resident of Amesbury Road, Cholderton, had pleaded not guilty to all charges, but was found guilty on all counts by a jury at Winchester Crown Court yesterday (Wednesday September 9).

The jury had previously retired on Tuesday September 8 to consider evidence from the trial, which had begun on September 1.

Sentencing followed shortly after the verdict was given, when Cull was sentenced to a total of 51 years and eight months by Judge A J Barnett, the Recorder of Salisbury, across all counts. The sentences are to be served concurrently, so that Cull will spend 13 years in prison, as well as a year on extended licence. He was also ordered to sign the sex offenders’ register indefinitely.

The historic nature of the crimes meant that sentencing took place based on the laws in place at the time. Sentencing guidelines for the rape and sexual assault of a child now carry a maximum sentence of life imprisonment.

The court had previously heard his victim’s testimony to police, where she said that he had asked her to choose what she wanted done to her from the pages of a pornographic magazine, “like a catalogue.”

As a four-year-old, he would “stroke” her privates over her underwear, and from the age of eight onwards, he made her “lie across his lap on the sofa without any pants.”

The court heard that he began to assault her using his fingers, “nicking” her on some occasions as he did so, while she was also forced to dress in adult lingerie and touch Mr Cull inappropriately.

The victim said that he acted like a “teacher”, teaching her how to give oral sex and showing her his semen. It is also claimed he would make “sexual phone calls” to the girl while pretending to be a stranger.

The victim described the assaults as like she was “being torn apart” and having “burnt her brain,” and that she “died a thousand deaths to survive it.”

Anonymous sources had previously described Cull as a “longstanding pillar of the community” who had been President and Treasurer at a number of local organisations, as well as being a member of a village playgroup committee.

After the sentence was passed, Cull was taken from the dock to begin his sentence.

Festival Park pervert drives 120 miles to carry out sex act on boy, 15

A 21-year-old pervert drove three hours to Stoke-on-Trent – to carry out sex acts with a schoolboy at Festival Park.

Alistair Eccleston had started messaging the 15-year-old on Instagram when he drove from his Swindon home for the sexual rendezvous.

But the former retail worker was later arrested and has now admitted two counts of causing or inciting a child to engage in sexual activity.

Now he has been handed a two-year jail sentence, suspended for 24 months.

Prosecutor Steven Bailey told Stoke-on-Trent Crown Court: “They hugged and drove to a Festival Park car park. The defendant tried to kiss but he resisted. The defendant then began to touch and kiss his genital area. Each of them performed a sex act on each other.

“They stopped a few times when other cars drove past. He did admit he’d known he was 15.”

The court also handed Eccleston a Sexual Harm Prevention Order. He must also carry out 140 hours unpaid work.

Judge David Fletcher told him: “The three hour drive from Wiltshire to Stoke-on-Trent is a clear example of the determination which you showed to enable you to commit these two offences.”

Benjamin Kinderman – Streatham/Marlborough

Wiltshire man jailed for sexual abuse of girls

A baptist who sexually abused two girls when he was still in his teens wrote to one victim asking forgiveness for having “behaved improperly” towards her.

Ben Kinderman, 38, was 15 or 16 when he carried out the vile assaults on the two girls at his parents’ farm near Marlborough in the late 1990s.

Prosecutor Barnaby Shaw told Swindon Crown Court on Thursday that Kinderman had grown up in a Baptist household.

He had admitted molesting his older victim, who was no older than 10 at the time of the assaults, on three occasions.

Kinderman took her to isolated locations on the farm, touching her sexually near a bonfire while they were alone. She was said to have suffered extreme pain as a result of the ordeal and he continued despite her pleas that he stop.

On another occasion, when they were playing table tennis in the cowshed, he got her to collect a ball that had been hit far into the next shed so he could paw her as he lifted her over the wall dividing the sheds.

He also molested her in the back of a car on a journey – despite the presence of others in the vehicle.

The younger girl, who was around six, said she had been touched sexually by Kinderman as she lay in a bed with him. There were others in the room.

In a letter to the older victim, sent in 2009 while she was at university and shortly before his baptism, Kinderman told her he hoped he had been forgiven for having “behaved improperly”.

He said it would be “a mercy” to feel that God was able to forgive sinners who are truly repentant.

Interviewed by the police in 2020, he suggested what he had been doing was “experimenting”. He accepted it had been wholly wrong of him to do what he did.

In a victim statement, the older girl said she felt he had completely minimised what he did and the effect his actions had. She had suffered breakdowns at university as a result of his letter.

The second victim said the abuse had left her with the mentality of wanting to please men, leading to a series of unhealthy relationships. She said she felt guilty about not being aware of what the older girl was going through.

Sending Kinderman to prison for three years on Thursday afternoon, Judge Crabtree told the defendant: “She has nothing to be guilty for. The guilt lies with one person in this courtroom and that is you.”

He said of the man’s older victim: “It is clear that your abuse of her has had a very real and enduring impact upon her health. She recalls at the time and as a teenager being unable to sleep and believing she would be unable to marry and have children.

“She was terrified of anyone finding out about what you were doing as she believed what she had done was wrong.

“Of course, there was only one person who was doing wrong and that was you; even as a 15 or 16-year-old youth.”

Kinderman, of Streatham, London, pleaded guilty at an earlier hearing to four counts of indecent assault. He has been sent to prison for three years, he must register as a sex offender for life and he will be subject to a sexual harm prevention order indefinitely.

Sex offender warned to expect lengthy jail sentence

A man has admitted a string of sexual assaults on young girls.

Benjamin Kinderman, 38, was in his early 20s when he molested two girls between 1997 and 2004.

The girls were aged between eight and 14 when the assaults took place near Marlborough, Wiltshire

Appearing before Swindon Crown Court on Friday, Kinderman, now of Rustic Avenue, Streatham, pleaded guilty to four counts of indecent assault. He denied a fifth count alleging multiple indecent assaults on one victim between June 1997 and May 2004.

Judge Peter Crabtree bailed the man to return to court for sentence on April 12, telling the defendant’s lawyer that custody was “almost inevitable”.

He said the intervening period on bail would allow Kinderman to get his affairs in order.

The judge added to Kinderman: “These are extremely serious offences, the starting point is a lengthy period in custody as you will have been told. But you’ve pleaded guilty – that will be important in avoiding a trial – and you were under 18 at the time you committed these offences.”

The defendant was ordered to register as a sex offender.

Wiltshire man admits having child sex abuse images and extreme animal pornography

A partially blind man has pleaded guilty to possession of child rape images and images of humans having sexual intercourse with animals

Colin Boon had been due to stand trial this week on more than a dozen allegations he had the illicit images of children – including more than 120 in the most serious category showing the rape or torture of children

But after discussions between prosecutor Stephen Dent and the 61-year-old’s barrister Charley Pattison, the Wiltshire man was rearraigned at Swindon Crown Court yesterday.

He pleaded not guilty to attempted sexual communication with an child named in court only as “Shannon”.

He was read 13 other charges relating to the possession of indecent and prohibited images of children or illegal images of animals, answering “on the advice of counsel, guilty” to each charge.

Appearing before Swindon Crown Court holding his white cane, Boon, of Bratton Road, Westbury, admitted possession of 125 indecent images in category A, the most serious category and which includes depiction of child rape, more than 80 images in category B, 190 in category C, 14 prohibited images of children and 77 extreme pornographic images depicting sex between people and animals.

Judge Peter Crabtree adjourned the case for the preparation of a pre-sentence report and medical evidence. He warned Boon’s lawyer that the starting point was a year’s imprisonment.

He will be sentenced on March 22.

The judge said his pleas would result in him being subject to sex offender notification requirements, meaning Boon must tell police of any changes to his address.

Robert Cole – Chippenham

March 2020

Incest dad who preyed on teenage daughter is jailed

A depraved dad caught on CCTV performing a sex act on his long-lost teen daughter has been jailed.

Robert Cole, 42, was reunited with daughter Justine Henley in 2018 after her 18th birthday – and 15 years after she was taken from his care and placed first with her grandparents before staying with a series of foster carers.

Swindon Crown Court heard the girl, now 19, had been bullied at school and had asked to be put in touch with her birth father after her foster dad left her adopted home.

Cole, who now had other children by his wife of 17 years, was keen to meet his estranged daughter.

The pair hit it off, but the relationship quickly became darker.

Prosecutor Rob Welling said Henley’s foster mum had contacted police after the teen asked if it was illegal to have sex with a family member.

A constable spoke to the pair at Cole’s home in Chippenham, warning them that incest was a crime. Cole’s wife also sensed her husband and his daughter were getting too close and warned him off.

The dad and daughter attempted to have sex for the first time on December 20, 2019 – Henley’s 19th birthday.

Their illicit liaisons were captured on CCTV at his house.

Texts between them revealed the dad saying he would leave his wife, even sending the girl a picture of an engagement ring in an apparent promise of his intentions towards Henley.

Mr Welling said the girl was vulnerable. She suffered from depression, had been passed from family to family as a child, was significantly overweight and had been bullied at school.

“She was in many ways at the beginning of that relationship, if I can put it in those terms, vulnerable. The starting, default point for any father – even if there was a sense she was actually encouraging him – should have been discouragement on his part,” he said.

Cole, formerly of Hill Rise, Chippenham, and Henley, of Hilperton, pleaded guilty to two counts of sexual activity with an adult relative.

Jailing the dad for 18 months, Judge Jason Taylor QC acknowledged that he had been charged alongside his daughter. But he said: “I make it plain at the outset that while you will both stand in the dock albeit at different times your positions are not equal.

“She was vulnerable and you preyed on those vulnerabilities when as the adult you should have protected her not least from herself. That makes your offending far more serious.”

The judge added: “I have little hesitation in concluding that she has been and will continue to be psychologically damaged by these events, even if she can’t fully process it herself right now. These consequences will be long lasting, perhaps lifelong lasting and they will make the indignity of being tested for pregnancy and sexually-transmitted infections pale into insignificance.”

Henley received a 12-month community order with 60 hours of unpaid work and 24 rehabilitation activity days.
