Convicted Washington rapist jailed after ‘misleading’ police about where he was living

A convicted rapist has been sent back to prison after failing to update police with his details because it was “easier” not to.

Darryn Seaman was given a five year sentence in 2007 for rape and was made to sign the sex offenders’ register for life.

The 52-year-old must follow strict conditions so he can be monitored by the authorities, including making them aware of where he is living and who he is staying with.

The court heard how Seaman, of Southcroft, Fatfield, Washington, has 10 previous convictions for 14 offences.

Since his rape conviction, he had failed to comply with notification requirements in 2016, 2017, 2018 and 2019 with the latest resulting in a 13-week custodial sentence.

Newcastle Crown Court heard Seaman had failed to notify police his address had changed following the breakdown in his relationship with his ex-partner in May last year.

He moved out of their home in Southcroft, Washington, but did occasionally stay at the address up until September.

Seaman lived in a number of premises over a 12-month period, including at Toll Bar House on Ryhope Road, Sunderland.

On a number of occasions he was living in a van, but Seaman claimed he did not know he had to tell police this.

Michael Bunch, prosecuting, said: “He failed to notify police of those changes of address and indeed in September of last year and April of this year provided the police with the same address of Southcroft [Washington] being his current home address.

“In May of this year he gave a further address of Penyghent Way [in Washington] as being his new permanent address.

“Effectively therefore from May 10 last year when he left Southcroft until May 13 this year when he registered his new address, police were ignorant to the fact he had moved and no longer residing at the address they held for him.

“In fact he actively misled them as to the location of which he was living.”

Seaman was arrested on June 16 and accepted he had been living at various addresses and failed to tell the police because it was “easier”.

He appeared at Newcastle Crown Court on Thursday after admitting to failing to comply with a notification requirement.

Recorder Carl Gumsley sentenced Seaman to 24 weeks in prison, of which he will serve half in custody.

He told him: “You still don’t seem to be getting the message and you’re going to head towards that five-year sentence in the future unless you actually do what you are told to do.

“You have to learn to obey court orders.”

Seaman was also ordered to pay a victim surcharge.

Carer performed sex act to paedophile hunters’ decoy acting as 14-year-old girl on video call

A paedophile who masturbated to who he thought was a 14-year-old girl on a video call while working as a carer has been sentenced to 15 months in prison.

Unbeknown to Scott Swindle, the lewd messages he was sending was actually to a member of the vigilante group Child Online Safety Team posing as a teenager on social network and dating app Skout.

After sending images of his penis, he asked for naked pictures and called her “beautiful” and “sexy”

Swindle said he wanted to take the 14-year-old’s virginity and also mentioned the pair having a threesome with his girlfriend.

He acknowledged during the conversations what he was doing was “probably illegal” but insisted she was “worth the risk”.

Newcastle Crown Court heard it was on December 16, 2019, when Swindle first contacted the decoy profile using a fake profile under the name ‘Chris’.

He opened the conversation saying “hi, how are you today?” and followed it up six minutes later with “are you horny?”.

Kevin Wardlaw, prosecuting, said: “The defendant asked if she was bisexual as her profile stated she liked men and women.

“[He] Asked if she had ever had a boyfriend, which she stated ‘no’.

“[He] Asked if she’d like a boyfriend or kissed anyone other than a family member and if she was a virgin before asking if she’d like to have sex with someone followed by a kiss.

“He asked when she was free to lose her virginity. When she indicated she was, he sent further images of his penis stating ‘inside you though’.”

Swindle did not respond to requests from the decoy for an image of his face as he stated he believed it was “probably illegal” for him to be even talking to her.

The 34-year-old even suggested the teenager come to his home so she could have a threesome with him and his girlfriend.

Mr Wardlaw added: “He stated he wanted to kiss her body all over repeated he could not wait to take her virginity. He asked her ‘can I lick your p**** for you?’ and he said ‘I’m going to f*** you all over’.

“He also encouraged the decoy to masturbate and asked her if she’d enjoyed it.

“When she said she had not, he stated he would help her to orgasm.”

The conversation switched to video calls, during which Swindle would masturbate to who he thought was a 14-year-old girl.

The court heard that he performed the sexual act from a number of locations including his place of work where he was a carer.

Swindle was rumbled on January 5 last year when he allowed his face to be seen on screen during a video call.

The decoy was able to take a screenshot and identified the emblem on his shirt which revealed his place of work.

Police were called and officers arrested Swindle, who admitted his offences when interviewed.

He pleaded guilty to attempting to engage in sexual communication with a child and attempting to cause a child to watch a sexual act.

The court heard how Swindle’s Hetton home had been “ransacked” after being broken into a number of times since his arrest.

He is currently living in a Newcastle hotel, his partner has left him and he lost his job as a carer

Dirty driver asked children for directions while carrying out sex acts in Heaton

Two children and a teenager were left traumatised after a driver called them over to ask for directions only for them to see him carrying out a sex act at the wheel.

Euan Martin, who has a well-paid job in digital marketing and owns properties in the North East, claimed he was driving around looking for houses to buy.

He first called over an 18-year-old student in Heaton, Newcastle, to ask where a road was and when she approached to try to help she was disgusted to see what he was doing.

He then drove to a residential street nearby and did the same thing to two sisters, the youngest of whom ran off screaming at what she saw.

Newcastle Crown Court heard both incidents happened on the morning of September 26 last year.

Martin, originally from the North East and who has family here but was living in London, was in the area of Chillingham Road around 11.30am when he first struck.

An 18-year-old who recently moved to the North East to study was walking when Martin stopped her and asked for directions to Heaton Park Road.

Christopher Rose, prosecuting, said: “She was going to look at her phone and when she got to the vehicle she saw his penis was exposed and he was masturbating.

“She described giving a disgusted sigh and walking off.”

In a victim impact statement, she said: “It made me feel incredibly upset and regretful about moving away from family support.”

Mr Rose added: “She found what he did to be obscene and disgusting. She rang her mother and cried as soon as she was away.”

Half an hour later, Martin drove his small red car to a residential back lane in Heaton, which was covered by CCTV.

He was seen to drive slowly along then stop and reverse back a short distance. After stopping, he lowered his trousers.

The two young girls came from the direction Martin reversed back from and as they passed his car he asked them, through the passenger window, where Heaton Park Road was. They then saw he was carrying out a sex act.

Mr Rose said: “(The older girl) was scared he might get out and chase them and thought afterwards he might turn up at her school.

“(The younger girl) said as she passed the car the defendant said ‘can I have a moment with you’. She replied no.

“She ran home screaming because, she said, he was doing some dirty business which she didn’t like.”

One girl’s mother said in a victim impact statement: “I would like it to be known both of my children were left extremely distressed.

“They have never been exposed to nudity and this left both of them confused and scared. This should never have been the way either of them experienced male nudity such as this for the first time.

“It made real a mother’s worst fears in terms of a stranger calling your children over to their car for a sick purpose.”

She added “(The youngest) thought he was there to collect her and take her away from me and that she would not see me again. No child should ever be made to feel that way. She had many sleepless nights.

“(The oldest) was also really distressed. She thought she was being chased and that the person knew where she lived.

“It made her upset and scared to go to school because she feared he would be waiting there.

“We had nearly a year of them not wanting to do the things they usually enjoy because they were so scared a man in a red car was going to try to take them or do things to them.

“I’m so angry this person has made them feel this way.

“I live in constant turmoil about what he meant and what his plan was and how close I came to losing her if he acted any further than he did on his very sick urges.”

Martin was traced by his car registration plate and arrested.

He initially claimed he was trying to “relieve himself” and frantically covered up when he saw the children near his car but went on to make full admissions.

Martin pleaded guilty to exposure and two counts of engaging in sexual activity in the presence of a child and was sentenced to 23 months suspended for two years with 150 hours unpaid work, a sex offenders treatment programme and a £500 fine. He will also be on the sex offenders register for ten years and must pay the victims compensation – £1,000 to each child and £300 to the teenager.

Judge Sarah Mallet told him: “Both children were extremely upset.

“They were terrified, confused and scared.

“You have brought shame on yourself and your family.”

The 32-year-old has a caution for outraging public decency in 2015 when he carried out a sex act while standing at a window on a busy street.

The court heard Martin, of Marville Road, Fulham, London, owns properties in Tyne and Wear and has family in Northumberland.

Sunderland pervert’s collection of indecent images included a baby in ‘pain or distress’

A pervert whose collection of indecent images of children included a baby in “discernible pain or distress” has walked free from court.

Stephen Collier had entered search terms seeking out the child abuse material, which police found on his computer hard drives.

Newcastle Crown Court heard one of the images showed a one-year-old in pain or distress.

Officers went to his home on North Hylton Road, Sunderland, in April last year and seized his computer equipment.

In total, they found 33 of the most serious, category A, images, 52 category B and 40 category C.

The youngsters featured were aged between one and 15.

When he was interviewed, Collier claimed he had been downloading legal pornography when the indecent images started to download. He said he deleted them but they downloaded again.

He said he was using search terms including the phrases “pre teen” and “incest 10-year-old girl” in order to find where the images were coming from.

Collier, 56, who has no previous convictions, pleaded guilty to three counts of making indecent images of children.

He was sentenced to eight months suspended for two years with 80 hours unpaid work. He must also sign the sex offenders register and be subject to a sexual harm prevention order for ten years.

Judge Julie Clemitson told him: “The images include some images of extremely young children, as young as one and including one where a young child is distressed.

“You deliberately sought out such images. You were looking for not just images of children but those that had an incestuous element to them and had depictions of rape.

“Most were recovered from deleted files.

“You need to acknowledge viewing images of children perpetuates the harm of children all around the world who are raped and abused.”

Judge’s disgust at reading pervert’s sick messages to teen

Text messages sent by pervert Gavin Charlton to a teenager left even a crown court judge shocked.

The 40-year-old, who has no previous convictions, pleaded guilty to engaging in sexual communication with a child.

And as he was in the dock at Newcastle Crown Court to be sentenced, Recorder Craig Hassall told him it was a “shocking experience” reading the messages he sent his young victim.

The judge said: “You are a man of good character, that makes it all the more shocking an experience to read the text messages you sent and seeing your invitation to her to engage in sexual activity.”

Christopher Rose, prosecuting, described how the victim was left shocked and distressed after Charlton sent her sexual texts.

“The text messages came out of the blue,” he said “She immediately told a school friend, who took it to a teacher.

“She was very distressed when speaking to the teacher. She remains very distressed by what has happened. The impact is immense.”

Mr Rose also read a statement from the victim, whose identity is protected by law, in which she describes the impact Charlton’s crime had upon her.

“I was completely shocked and disgusted. His actions have had a devastating effect,” she said. “This is something I have thought about every day. I find it harder to trust people. I get anxious when I’m talking to new people. I have become quite withdrawn.

“I spend a lot of time in my room and I feel as though I’m isolating myself.”

Charlton, of Garth 22 in Killingworth, was sentenced to 12 months in prison, suspended for 18 months.

Recorder Hassall told him “The way she describes the effect on her is absolutely heart-rending. She is still dealing with the devastation”

Charlton will also have to complete 150 hours of unpaid work as part of his sentence and must sign on the Sex Offenders’ Register for 10 years.

He was also given a restraining order to keep him away from the victim.
