Pervert Airdrie politician who told detective he wanted to rape child is spared jail

A pervert politician who told a detective he wanted to rape a child after being targeted in an undercover police sting has been spared jail.

David Fagan, 53, a former Labour councillor, used depraved websites to investigate “taboo” subjects including having sex with a parent and child.

The father-of-two from Airdrie, Lanarkshire, shared warped fantasies about incest while talking to an undercover policewoman who had been alerted to him.

She told him she was a 40-year-old mother-of-three from London and Fagan exchanged a series of explicit messages discussing sexual fantasies involving her and children.

Fagan was categorised as “high risk” and arrested after the online conversations of 2016 and put on trial at Airdrie Sheriff Court.

The trial heard claims he had agreed to pay money to meet the woman and rape one of her children in her presence.

Disgraced Fagan told a jury he never planned to carry out the rape but did fantasise about perverted sex acts.

A jury unanimously convicted him of sending messages in relation to incest, the sexual abuse of children and the rape of a child, between May and August 2016.

But they found a charge he conspired to meet a 14-year-old girl for sex while another girl, aged 12, was present not proven.

Fagan has now been ordered to perform 120 hours of unpaid work and be supervised for three years.

He has also been placed on the sex offenders’ register for three years and banned from the internet for a year.

Ex-Hull councillor Steven Bayes jailed for sick and extreme images – and still denies it

Unrepentant paedophile Steven Bayes left court in the back of a prison van after being jailed for a year.

The disgraced former city councillor and NHS nurse, who had also served as Humberside PoliceAuthority chairman, was convicted by a jury of two offences of making indecent photographs of children, and one of having “extreme” images, after a Hull Crown Court trial in February.

Bayes, 56 – who called himself “Lord of Darkness” on Twitter – had denied any wrongdoing and tried to lay the blame for the material found on his computers on a “vulnerable” young adult, Recorder Richard Woolfall told him when sentencing him on Friday.

His barrister, Richard Thompson, conceded the offences crossed the custody threshold, but asked on Bayes’s behalf for the sentence to be suspended.

There were still things to be said in his favour; he had no previous convictions, had devoted much of his life to public service, and was able to provide positive character references from friends and colleagues who continued to stand by him.

But his chances of walking free from court evaporated when it emerged Bayes was still refusing to accept his guilt in his pre-sentence interview with the probation service.

The judge called that “particularly worrying”, and contrasted it with defendants in similar positions, who were “contrite” and “cooperative”.

After he was jailed, Bayes’s former political boss in the city and a leading children’s charity both had the harshest of words for him.

Claire Holmes, prosecuting, said one of the videos showed a child in “discernable pain or distress”, who was “crying in pain” and said “no” as he began being seriously sexually abused by a man. The judge told Bayes he “found pleasure in the sexual abuse of children”.

The day began badly for Bayes, with police having to intervene when two men describing themselves as his “friends” clashed with TV crews outside court.

Bayes, of Prospect Street, city centre, was made subject to a sexual harm prevention order for ten years and must register as a sex offender for the same period.

Jury finds high-profile Hull councillor guilty of making indecent photos of children

A jury has today found a Hull councillor guilty of making indecent photographs of children.

Steven Bayes, 56, former vice-chair of the City of Culture company, and a Cabinet member with responsibility for overseeing long-term regeneration, until he was suspended, was found guilty of two counts of making indecent photographs of children.

He was also found guilty of a third count of possessing extreme pornographic images, involving adults and animals, by the jury at Hull Crown Court which had spent just over five hours deliberating.

Judge Recorder Richard Woolfall warned Bayes, a nurse at Hull Royal Infirmary until being suspended in 2016, that he could face a jail sentence, adding:”All sentencing options will be open to the court, including custody.”

Bayes will have to sign the Sex Offenders Register.

Bayes was charged after police raided his flat in Hull in August 2016 and took away a Hewlett Packard laptop computer, which was found to contain the illegal material, from an iOS back-up from two iPads.

The indecent images, which contained images and film clips of children thought to be as young as seven, were only revealed through a forensic examination of the laptop and could not be seen without specialist knowledge.

During cross-examination he said if he had known there were indecent images on his laptop “I would probably have dropped it into the sea off a North Sea Ferry. It’s like kryptonite – you don’t want anything to do with it.”

Gay Labour councillor loses legal challenge over underage sex

A Labour councillor who was arrested in a Belfast hotel room in 2007 with his 17-year-old boyfriend has failed in a bid to bring a legal challenge against police.

Hull City councillor Steven Bayes, 47, was found with his boyfriend Dale Martin, who was 17 when he was arrested. At the time, the legal age of consent for gay sex in Northern Ireland was 18. This has now been lowered to 16, in line with the rest of the UK.

Following the arrest, both men had their homes and offices raided by police.

Bayes, a councillor for Hull, argued a judicial review was necessary because his privacy had been breached and he had been discriminated against.

The proceedings were launched against the Police Service of Northern Ireland and the Public Prosecution Service.

Bayes was told in July that no action would be taken because it was not in the public interest.

His legal challenge was rejected, with the main reason being a delay in applying.

The judge said the legal landscape had changed since the arrest, pointing to the change in the age of consent.

Bayes criticised police and prosecutors for how the case was handled.

According to the BBC, he said: “The police just came in with their big stomping feet all over everything and didn’t look at it, bearing in mind the law was changing.

“If it wasn’t in the public interest in July 2009, it wasn’t in the public interest in December 2007 and they should have known that.”

The couple are now engaged. Bayes maintains that he believed Martin was 18 when they first met online.

‘Predatory’ private tutor and ‘pillar of the community’ who worked for a child safety agency is jailed for five years

A ‘predatory paedophile’ who worked for a city’s child safety agency while simultaneously grooming young boys for sex has been jailed for five years.

Private tutor and parish councillor Heathcliffe Bowen, 50, of Ilkley, West Yorkshire, was regarded as a ‘pillar of the community’, a court heard.

But while Bowen was administrator of the Safeguarding Children Board, in Bradford, he paid an under-age boy for sex and took part in sexually explicit online chats with other youngsters.

He had also been chairman of a parish council when sex monster Jimmy Savile was invited to switch on the town’s Christmas lights.

Military historian Bowen, who had also been chairman of Ilkley Parish Council, was convicted of three charges of attempting to cause or incite a child to engage in sexual activity, one of arranging or facilitating the commission of a child sexual offence, one of attempting to meet a child for sexual activity, one of attempting to cause a child to look at an image of sexual activity, and four charges of distributing indecent images of children.

He was also convicted of six charges relating to attempts to engage children in sexual activity and attempting to meet one child after sexual grooming.

The Recorder of Bradford, Judge Jonathan Durham Hall QC, said Bowen had a ‘deep and entrenched interest in underage children’.

Prosecutor Christopher Rose told a jury that Bowen’s offending had arisen from online conversations he had engaged in using Skype.

He said some of the allegations involved attempting to engage ‘young teenage men’ in sexual activity, including ‘meeting men for sex’.

Police later identified one of the people Bowen had communicated with as a 15 year-old boy.

Mr Rose said: ‘The conversations make it obvious that they were regularly meeting up for sex, for which sometimes the defendant paid.’

One of the exchanges involved Bowen inviting someone who told him he was a boy in Year 8 at school to have unprotected sex if he ever visited Leeds, with another discussion including an offer to take the virginity of a user who said he was a 12-year-old boy.

In one conversation using a webcam, Bowen performed a sex act on himself on camera while a 15-year-old boy watched.

The defendant, of Woodlands Rise, Ilkley, was also convicted of distributing and possessing indecent images of children.

He had told the jury that his online interactions were ‘completely devoid of reality’, claiming he was just chatting to other adults in a ‘fantastical role play environment’, acting a role in a ‘bizarre internet drama’.

Bowen worked as an administrator for Bradford Council in social services and safeguarding from 1995 to 2014.

Before his trial he had already admitted three charges of possessing indecent images of children, and was cleared of one charge of attempting to cause or incite a child to engage in sexual activity.

David McGonigal, mitigating, said Bowen had been diagnosed with an ‘anxiety and depressive disorder’ at the height of the chats in 2014, triggered by disciplinary proceedings linked to his job.

He said Bowen had repressed his sexuality for most of his life, only recently telling his 93 year-old mother, with whom he lived and was the carer for, that he was gay.

Mr McGonigal said Bowen had served the Ilkley community for 20 years, adding: ‘He has lost everything as a result of these convictions. It is difficult for him to admit what he has done.’

Bowen was a well-known figure in Ilkley’s civic community, having served as a parish councillor for 20 years and as council chairman three times.

During his chairmanship, Jimmy Savile was invited to turn on Ilkley’s 2011 Christmas lights, but the now disgraced DJ and prolific sex attacker died aged 84 before he could honour that commitment – it would have been the third time he had switched on the lights.

Bowen was Chairman of the council at that time and back in 2011, said a formal letter of condolence would be sent to Sir Jimmy’s family.   

Its independent chairman, David Niven, said: ‘We are grateful that a comprehensive investigation has caught a serious offender.’

Former Moray councillor admits child abuse images charge

A disgraced former Moray councillor has admitted possessing naked photographs of children.

Sean Morton, formerly of Lhanbryde, has pleaded guilty to keeping pictures of girls, possibly as young as 10, on his laptop.

Police also found images of adult men and women engaged in sexual activity with dogs.

The former Labour councillor was ousted from the council chambers in May’s election after the allegations first emerged in December last year

Following his defeat in the vote, the 36-year-old described the charges as a “smear on my reputation” in a social media post.

But yesterday he admitted a charge of possessing extreme pornographic material depicting adults engaging in sexual activity with animals between November 8 and 29, 2013, and a charge of “taking or permitting to be taking” indecent photographs of children on November 11, 2013.

Former councillor jailed for downloading sickening videos back in court

A former Lincolnshire councillor who was jailed for downloading images of child abuse has appeared back in court.

Ian Dolby, of North Road Sleaford, had been jailed for two years in August 2017 after admitting to downloading images of children.

The 55-year-old pleaded guilty to 23 charges of making an indecent image of a child on the second day of his trial after police found 700 computer discs at his home in Sleaford.

Dolby, who was described in court as having a “rapacious interest” in downloading indecent images from the internet, was placed on the sex register for 10 years and given a sexual harm prevention order to control his behaviour when released.

Now he has appeared in court again after breaching his sexual harm prevention order.

The former Sleaford Town Councillor refused to hand over a device capable of accessing the internet for inspection when he was asked to by the authorities on August 29, last year.

The former councillor appeared at Lincoln Magistrates’ Court on December 12, last year, where he pleaded guilty to the offence.

Dolby was fined £150 and ordered to pay a £32 surcharge to fund victim’s services and £85 in costs by magistrates.

At his original trial in 2017, the court was told police found a stash of more than 700 computer disks containing pornography in Dolby’s bedroom as part of their inquiries after officers arrested his lodger for an unrelated matter.

Of these, 45 disks contained child pornography, including more than 500 movies lasting 184 hours. These had been downloaded between 2010 and 2013.

Sending Dolby to prison, Judge Simon Hirst had said: “You have done everything you possibly could to avoid facing up to your wrong doing.

“This type of offending is not victimless in any way. Every still photograph and every frame of a film has the face of a child who has been sexually abused in the most cruel way imaginable.

“In behaving as you did, you perpetuated the market and distribution of such images and encouraged the making of more images.”

Ex Sleaford councillor jailed for indecent images

A former independent councillor who admitted possessing child sex abuse images has been jailed for two years.

Ian Dolby, 52, of North Road, Sleaford, Lincolnshire, pleaded guilty at Lincoln Crown Court to 23 counts of making indecent images of children.

A police raid on his home in December 2013 found more than 700 computer discs containing pornography, 45 of which contained child sex abuse.

Dolby resigned from North Kesteven District Council in April 2014.

He was sentenced at Lincoln Crown Court earlier.

Jail ‘overwhelmingly likely’ for former councillor

A former Lincolnshire councillor facing child sexual abuse images charges has changed his plea to guilty, a court has heard.

And a judge has told him it is highly likely he will face a jail term.

Ian Dolby, who was a member of North Kesteven District Council until April 2014, had been on trail in front of a jury at Lincoln Crown Court facing 36 charges of making an indecent image of a child.

Jurors had previously heard Dolby had “a rapacious interest” in downloading indecent images from the internet after police found over 700 computer disks at his home in Sleaford.

Martin Hurst, prosecuting, said that 45 of the disks contained images of sexual abuse of children.

However, the 52-year-old of North Road had pleaded not guilty to 36 charges of making an indecent image of a child.

But, on the second day of proceedings on Wednesday, August 16, Dolby admitted to 23 charges relating to a police search of his home in 2013.

The other 13 charges are not to be pursued by the prosecution.

Judge Simon Hirst told him: “You have sought to avoid pleading guilty or being found guilty in any way you possibly could. Custody is overwhelmingly likely. The fact that I adjourn the case for a report should not be taken in any way to mean you won’t receive a custodial sentence.”

Dolby served as an Independent member for the Quarrington Ward of North Kesteven District Council. He resigned his seat in April 2014, five months after the police raid, citing “pressure of work commitments”. He also resigned from Sleaford Town Council at the same time.

The court was told that Dolby has no previous convictions and is currently working as an accountant.

Martin Hurst, prosecuting, earlier told the jury that the police search carried out in December 2013 followed the arrest of Dolby’s then lodger over a completely unconnected matter.

Mr Hust said that officers who initially went to the property discovered photographs of unclothed young girls on the walls and folders containing photographs of young girls.

As a result CID officers were asked to attend and a detailed search was carried out.

Mr Hurst said: “They searched the whole house. They searched in particular Dolby’s bedroom and took away quite a lot of things principally electronic devices including a lap top.

“Also in his bedroom they found a very, very substantial library of DVD disks.

“These were DVDs he had made at home. He had burned them from websites he had been visiting on the internet.”

Mr Hurst said that 45 of the DVDs contained around 180 hours of film of child sexual abuse including 46 hours of the worst category showing the rape of very young children

He told the jury: “They contained some of the most offensive material that you can imagine. The 45 DVDs contained principally or exclusively indecent images of children. The other 687 were dip-tested. 

Dolby was granted bail and will be sentenced tomorrow.
