Under-age sex man sentenced

A PORTSOY man who admitted having unlawful sex with a 14-year-old girl has been put on probation for three years and ordered to carry out 200 hours of community service.

George Innes (35), Gordon Crescent, was also put on the sex offenders’ register for three years when he was sentenced at Banff Sheriff Court.

An earlier court heard that Innes’ liaison with the youngster was uncovered after a graphic picture he had sent her of his private parts was found on a mobile phone.

Debbie Wilson, defence agent for Innes, said he accepted full responsibility for what had happened.

Another photograph on a mobile which George Innes (35) had given to the youngster showed him blowing her a kiss.

Text messages found by her mother on the girl’s own mobile also revealed the extent of the involvement between Innes and the girl.

At Banff Sheriff Court last week, fiscal depute Raymond O’Brien said that the mother initially became suspicious when she saw a love bite on her daughter’s neck, and knew that she did not have a boyfriend.

Innes, of 9 Gordon Crescent, was put on the Sex Offenders’Register by Sheriff Peter Hammond when he pleaded guilty to having unlawful sex with the schoolgirl at his home on October 9 last year.

He will be sentenced on July 12 after Sheriff Hammond called for reports.

The court heard that Innes, a joiner, befriended the schoolgirl while she was occasionally helping her father at his work.

Mr O’Brien added: “When the father changed his employment, Mr Innes and the daughter remained in contact.

“However, when the mother was trying to get her daughter’s phone to work, she noticed text messages from Innes.

“The girl initially denied being involved with Innes, but then admitted having sexual intercourse on one occasion with him.

“The girl became hysterical, saying the accused would get into trouble.

“A few days later, on October 29, her father found a second mobile his daughter had been using. The accused had given her the mobile, and it had messages on it that were indicative of a relationship.

“Police found additional messages and the two photographs.

“The girl was interviewed, and confirmed the details she had given to her parents, that she and the accused had consensual sex on one occasion at his home address.”

Debbie Wilson, defence agent for Innes, asked for reporting restrictions to be put on the case until Innes was sentenced, but that request was refused by Sheriff Peter Hammond.

He deferred sentence for a social inquiry report, a community service assessment and a restriction of liberty order assessment, and placed Innes immediately on the Sex Offenders’ Register.
