Pervert jailed and facing deportation

A 28-year-old who sent sexual messages and photos to both a real underage girl and a decoy has been jailed for two-and-a-half years and is now facing deportation.

Miguel Angelo Pereira de Freitas (28) appeared in the Royal Court on Friday to be sentenced for sending the sexual messages and photos, as well as one charge of being drunk and disorderly.

During the hearing, the Court heard that one of the recipients of his messages was an adult posing as a child, while the other was an actual minor whom he was propositioning for sex. He also sent her a photo of his genitals.

Crown Advocate Conrad Yates, appearing for the prosecution, explained that the first offence involved texts he sent on Facebook to a profile of a 13-year-old girl, which was actually being controlled by an adult, Cheyenne O’Connor.

De Freitas messaged the decoy profile telling her she was “beautiful” and asking her to send a photo of her in a bikini.

As well as sending the decoy a photo of himself and his genitals, he also messaged her: “You’re going to have sex with me, it’s not beautiful and it’s going to be your first… yes it hurts and only at the beginning.”

They also arranged to meet one another.

Screenshots of their conversation were sent to the Police by Ms O’Connor and De Freitas was subsequently questioned about the messages.

The other charge related to messages that he sent to an actual minor telling her she had “a gorgeous body” and that he was “horny” for her. This contact took place after he was interviewed by Police about his messages to the decoy account.

He also tried to make sure that she was deleting all of their conversations so he could keep their contact secret.

She said to him: “You know that I am young. And you can be arrested if anyone knows about our conversations…”

To this, he replied: “I know beautiful, but you delete all our conversations right?”

In another text, he wrote: “And nobody will see our conversations, beautiful… so I can send you the photo for you to see and then you’ll delete it! And this way nobody knows anything.”

He then sent her a photo of his erect penis. He propositioned her for sex and told her not to be “scared”.

The Crown Advocate told the Court that when he was interviewed about his contact with the girl, he claimed that he “was not the only person to blame” and told Police: “If she knew she was a minor, she knew that she could get into trouble why did she continue the conversations, right?”

When asked about the photo he sent to her, he claimed that it had been sent in error because his phone is broken, saying: “My phone is all smashed and was doing random things on its own accord.”

De Freitas was also charged with being drunk and disorderly on a separate occasion which involved him threatening his former partner outside her house.

The Crown Advocate invited the Court to jail De Freitas for a total of two years.

Advocate Michael Haines, defending, said his client “knows the difference between right and wrong” and that “his conduct in relation to these three offences is wrong”.

Arguing against a recommendation for deportation, the defence lawyer spoke of his client’s work ethic, his “difficult and extremely unsettling childhood”, and emphasised that “Jersey is his home”.

He also invited the Court to impose a non-custodial sentence for this offending, arguing that this would be “in the interest of the community and this defendant”.

The Court ultimately decided to impose a higher sentence than that asked for by the Crown, handing De Freitas a prison sentence of two-and-a-half years.

Lieutenant Bailiff Antony Olsen – presiding over the case, sitting with Jurats Ronge and Thomas – told De Freitas that he will remain on the Sex Offenders’ Register for a minimum of six years. Restrictive orders were also put in place to prevent him having unsupervised contact with minors for the same amount of time.

The Court also made a recommendation that De Freitas be deported back to Madeira upon his release.

It was decided that the reasoning for the sentence imposed would be included in a written judgment to follow at a later date.

Paedophile ex-servicemen jailed

A former serviceman who sexually touched a girl under ten and pleaded with paedophile gangs to allow him to watch their ‘parties’ with young boys over the internet has been jailed.

Scott Robert Fitzgerald bowed his head as the Deputy Bailiff sentenced him to three years and ten months behind bars for his crimes that included abuse of a ‘very little girl’.

The Royal Court’s Superior Number, which convenes only for the most serious offences, heard how the 41-year-old told a man on an internet chatroom dedicated to people interested in abusing children that he had ‘tickled’ and got sexual gratification from bouncing the young girl on his knee. Fitzgerald was, in fact, speaking to an undercover police officer in the UK.

Following a tip-off, police in Jersey arrested Fitzgerald and searched his home. Ten indecent images of children, some falling into the second-most serious category, were recovered.

The former St John Ambulance volunteer had been on the States police’s radar before, it was heard.

In 2011, evidence emerged of sexually orientated messages he had exchanged with a teenage girl. That case never made it to court and he was, instead, given ‘words of advice’.

Fitzgerald, who was orphaned as a teenager, was also placed on the Sex Offenders Register for a minimum of ten years and placed under stringent restraining orders limiting his contact with children.

Man (41) admits child sex offences

A 41-year-old man has admitted to sexually abusing a young child and possession of indecent images of children.

Scott Robert Fitzgerald appeared in the Royal Court on Friday, where he admitted three child sex offences, including ‘sexual touching’, and possessing indecent images.

Fitzgerald was represented by Defence Advocate Luke Sette who entered ‘guilty’ pleas on behalf of his client. 

As a result of Fitzgerald’s admission of guilt, Royal Court Commissioner Julian Clyde-Smith, presiding, informed the defendant that he is now subject to notification requirements under the Sex Offenders’ Law.

The Commissioner also informed him that the minimum number of years before Fitzgerald could apply to be taken off the Sex Offenders’ Register would be set on the day of his sentencing. 

Advocate Sette made an application for his client to undergo a psychological and psychiatric evaluation before he is sentenced.

Crown Advocate Emma Hollywood, appearing for the prosecution, asked that the case be adjourned for one week to set a sentencing date and Fitzgerald was taken back into custody until next Friday’s Court session.

Jersey man guilty of abuse of baby

A 31-year-old Jerseyman has pleaded guilty to child cruelty and assaulting a seven-week-old baby in Ireland 

Daniel Broadleday was sent to Ireland on 13 March after the Attorney General approved a request from the Irish Court Services to appear in court to face the charges

Born in Jersey, Mr Broadleday spent two years in Ireland after leaving the army in 2014. It is during his time in Limerick that he harmed a seven-week-old baby, leading the baby to suffer seizures and other serious injuries.

Broadleday pleaded guilty to three offences relating to the baby which include: Child abuse, child neglect and assault on a child 

Broadleday was extradited back to Ireland after he fled the hospital after the seven week old baby was taken in after suffering serious injuries including swelling to the brain.

Broadleday will be sentenced next month. He was remanded to prison until that time

Prison IT worker jailed over indecent images of children

A former prison IT worker is himself behind bars tonight having pleaded guilty to distributing indecent images of children.

28-year-old Simon Gascoyne distributed at least 12 images – both stills and video – some of which were in the most offensive category.

The police investigation also revealed Gascoyne had been accessing online pornography whilst working at the prison at La Moye.

His arrest and conviction followed a tip off from Homeland Security agents in the US.

They’d been carrying out their own investigations and sent Jersey Police a disc with details of conversations between various internet users who’d been using a specially created illicit site to share indecent images of children.

Gascoyne denied being a member of the group, but was later linked to it through two online accounts, one of which featured a tattoo he has on his shoulder of the character Eric Draven from the film The Crow.

In an attempt to try and cover his tracks Gascoyne had also used sophisticated software to ‘clean up’ his mobile phone history.

When questioned by the police Gascoyne told officers: “My life’s over, that’s simple… I feel like something I’ve been ashamed of, and desperate to hide, and desperate to stop doing has now become my entire identity, because that’s what happens.”

Sentencing, Bailiff William Bailhache, said he and the two jurats – Mike Liston and Dr Sally Sparrow – had spent a long time discussing the best way forward, but in the end had no choice but to jail Gascoyne.

“These are not faceless crimes. This crime has been made possible because someone has damaged children”, he reminded Gascoyne. “The community expects custodial sentences.”

Gascoyne was sentenced to 18 months and will be on the sex offenders’ register for at least five years.

Sex attacker jailed after years on run

A SEX attacker who was on the run for six years after being arrested for abusing a vulnerable woman has been jailed for seven years.

While Nathan Thomas John Jordan of Leicester, was at large in Ireland and the UK, a second woman came forward and claimed she too had been violently sexually assaulted by the defendant.

Eventually, police officers arrested the 34-year-old after he boarded a flight at Stansted Airport in February last year.

The Royal Court’s Superior Number, which convenes only for the most serious offences, heard that hi-tech-crime detectives had also found four indecent images of children on his laptop – pictures that showed infants aged between three and eight being sexually abused and raped by adult men.

But due to highly technical encryption software on the computer, which was protected by a pass code not disclosed to the police by Jordan, only partial analysis of the device was able to be carried out.

Crown Advocate Emma Hollywood, prosecuting, said it was the Crown’s case that the images were ‘highly likely to be a snapshot of a large quantity of material hidden behind encrypted areas’.

Internet searches for images showing the ‘sexual abuse, torture and humiliation’ of children were also found. Police also discovered TOR – a portal used to access the so-called dark web, a hidden part of the internet full of ‘terrorist related content, illegal activities and indecent images,’ the court heard.

Jordan, who is married, admitted one count of making indecent images of children, two counts of indecent assault and one of perverting the course of justice. As well as being jailed he has been placed on the Sex Offenders Register for ten years.

Jordan was described by a psychologist as a ‘complex man’ who would currently pose a ‘high risk in the community’.

During yesterday’s hearing, the court was told how Jordan, who describes himself as a journalist, forced two women to perform sex acts on him on two separate occasions. In one incident he threatened he would hurt the victim if she did not comply.

Victim impact statements, which were read in court, said both women were suffering from post-traumatic stress disorder and have flashbacks and nightmares.

Acting Inspector Cathy Davison, head of the States police Public Protection Unit, described Jordan as ‘controlling and coercive’.

‘This has been a long and complex investigation, with officers bringing Jordan back from the UK to face charges. We hope this sentence today will help the two victims recognise that justice has been given and assist them in moving on with their lives,’ said the detective.

Outlining the case, Advocate Hollywood said the defendant was arrested in August 2012 in connection with the attack on one victim. His laptop was then seized and analysed. He was interviewed again on 29 August but four days later fled to Cork, in Ireland, after ‘immediately resigning from his job’ and telling his boss he was leaving ‘for my own safety and safety of my loved ones’.

In 2015, the second victim came forward and reported the crime against her.

A wanted marker was placed against Jordan and he was eventually arrested on 15 February 2018.

Sex offender reoffends with over 45,000 indecent images of children

A man who was put on the sex offenders’ register by the Royal Court in 2012 has admitted breaching his restrictions by making 45,787 indecent images of children.

42-year-old Jeremy Thomas Bourke appeared in the Royal Court on Friday, accused of four counts of making the images of children under the age of 16 between July 2011 and September 2017.

The images – which include 103 at the most serious level – were kept on a number of storage devices including a PlayStation 4 game console. 

Defending, Advocate Adam Clarke, put forward guilty pleas for all four counts, as well as two counts of breaching the sex offender restraining orders that was imposed by the Royal Court on 9 November 2012, as Bourke was in possession of software which conceals the user’s internet activity, and for not handing over a device that contained 42,231 of the indecent images of children to Police Officers on 20 September 2017. 

Bourke has been remanded in custody and will be sentenced by the Royal Court on 23 July 2018. 

The Bailiff, Sir William Bailhache, who was presiding over the Royal Court also heard a separate case involving making indecent images of children.

33-year-old Nathan Thomas John Jordan, from Leicester,  pleaded guilty to possessing four indecent images of children, two at level three and two at level four – the second most serious level – on a Dell laptop between 16 December 2011 and 29 August 2012.

Jordan has been remanded in custody as the Solicitor General, Mark Temple, explained there was a risk he would leave the island as he does not live in Jersey.  

Defence Advocate Christine Hall did not dispute this, but requested the time Jordan has served in custody will be acknowledged by the Royal Court when he is sentenced on 22 June 2018.
