Man jailed for performing sex act on platform at Flint railway station

A man who exposed himself and performed a sexual act on the platform at Flint railway station has been jailed for 16 months, following a British Transport Police investigation.

Mark Jones, 39, of Church Street, Flint, pleaded guilty to outraging public decency and breaching a Sexual Harm Prevention Order (SHPO) at Llandudno Magistrates’ Court on 14 December 2020.

At around 7.20pm on 11 December 2020, a member of rail staff spotted Jones exposing his genitals and masturbating on the platform in full view of members of the public and passing trains.

Officers attended and arrested Jones on suspicion of outraging public decency. Jones was also later arrested for breaching a Sexual Harm Prevention Order (SHPO), specifically not to be under the influence of non-prescribed drugs in a public place and not to expose his genitals and/or masturbate in a public place.

Jones was sentenced to 16 months in prison at Mold Crown Court on 7 January 2021 and was handed a new SHPO for five years.

Saltney man avoids jail after admitting sexual communication with ‘child’ online

A Saltney man has avoided jail after he admitted having sexual conversations with what he believed to be a young girl.

Mark Payne, aged 42 and of High Street, appeared at Caernarfon Crown Court on Tuesday for sentencing.

He had previously admitted five offences; three of which related to his engagement with an individual online whom he believed to be a 13-year-old.

The other two related to images found on devices belonging to him.

Maria Masselis, prosecuting, told the court Payne had contacted the ‘girl’ via a social media app in April last year.

He was informed that the person he was talking to was 13 years of age, as the profile purported.

But Payne was in fact speaking to a police officer who was operating a decoy account.

Within a matter of hours he sent a completely unsolicited picture of his penis, telling the girl it something for her “to enjoy.”

He then asked for naked pictures in return – which was refused.

Payne went on to ask sexual questions, which led police to make enquiries.

Officers traced him and went to his address a few days later.

During the course of his arrest and a search of his property a phone, laptop and a USB storage device were taken for forensic examination.

He admitted having contacted the ‘girl’ but claimed he believed she was an adult and that he was “engaging in role play.”

On Payne’s phone, police recovered the image of himself which he’d sent via social media.

And on the laptop, books containing three indecent images of females aged 12 to 15 were found, as well as an indecent image of a female under the age of 18 performing a sex act.

When re-arrested and interviewed he admitted having downloaded the books, but told police he had no sexual interest in children.

Mr Recorder Duncan Bould told Payne: “In April you engaged with the person – within a single set of communications, but a very short space of time, you determined it was appropriate to turn that conversation into a sexual one.

“I am satisfied that you believed you were dealing with a young girl, even though you were not.

“You are a 42-year-old man, hitherto with no previous convictions and you have an excellent work record.

“I am satisfied that there is every prospect you can be rehabilitated without your immediate incarceration.”

Payne was handed an overall custodial sentence of six months – comprising sentences of four months, four months, six months and two months to run concurrently for counts one to four respectively.

No separate penalty was imposed in respect of the fifth.

The overall sentence was suspended for two years.

He must undertake a 60 day rehabilitation activity requirement and undertake 100 hours unpaid work in the community.

He was also made the subject of a seven year sexual harm prevention order.

Treuddyn man caught with indecent images ‘tried to destroy evidence’

A Flintshire man attempted to destroy evidence of indecent images as police searched his home, a court heard.

Samuel Ellis, aged 36 and of Ffordd yr Odyn in Treuddyn, appeared before Mold Crown Court on Thursday for sentencing.

He was convicted at Mold Magistrates Court at an earlier date for three offences of possessing indecent images, one offence of possessing prohibited images and possessing extreme pornography.

Anna Price, prosecuting, said on the morning of May 19 this year police executed a warrant at his home.Officers met him on his driveway and asked for his mobile phone, after which he became “panicked”.

He was taken inside the property by police and claimed he couldn’t find his phone.

Ellis was taken into custody while officers continued to search his home.

The device was only found when he was told he’d be strip-searched.

At that point he recovered it from his crotch area and upon examination officers found it to be wet inside.

He had used the toilet at his home while officers searched, Ms Price said, and it was believed used the opportunity to try and damage it before hiding it on his person.

Ellis later claimed he “forgot” he had it with him, and admitted to seeing indecent images on an app.

Upon examination, police found a number of indecent images of children – 25 category A , 11 category B and 22 category C.

The children were predominantly aged from three to 12.

Also discovered were 19 prohibited images.

Judge Niclas Parry told Ellis: “This is a worrying case – not only have indecent images of sexual abuse of extremely young children been viewed and looked for, they include moving images.

“The use by you of the internet has included extremely concerning comments regarding what was certainly your thoughts if not your intended actions regarding the abuse of children.”

“I am satisfied that there was an attempt to dispose of evidence that would hinder police.

“You’re a hard working man and you undoubtedly have mental health issues which will have contributed to this behaviour.”

Judge Parry handed Ellis an eight month custodial sentence, but suspended it for a year.

He must complete 60 rehabilitation activity days and pay costs of £340.

Ellis was also made the subject of a 10 year sexual harm prevention order.

Suspended sentence for teenager who viewed indecent images of children

A man who viewed indecent images of children was told there was ‘little to be gained’ from a custodial sentence.

Corran Burton, 19, of Rhydymwyn appeared at Caernarfon Crown Court for three counts of making indecent images of children between April 1, 2019 and March 13, 2020.

The court heard how Burton entered a guilty plea at Mold Magistrates Court.

Prosecuting Jemma Gordon said a report was made after an email address associated to Burton had been responsible for uploading an indecent image on the internet.

Based on that report, North Wales Police executed a warrant at the address in March of this year.

The court heard how he was arrested and a number of items were seized, including a mobile phone, which at first he accepted the phone was his, but denied there would be images on there.

After being examined, the phone was found to include images of predominantly female children around the ages of 5-12.

However, Ms Gordon said there were no live images and no internet history searches.

Judge Timothy Petts said Burton had ‘played his part’ in viewing these images but added he was ‘vulnerable and still maturing’.

He told the court there would be ‘little to be gained from a short custodial sentence’.

Burton was given a six-month custodial sentence, suspended for two years.

He was also ordered to complete 60 days of rehabilitation activity and 100-hours of unpaid work.

Pervert who set up fake accounts to groom children snared by paedophile hunter and undercover cop

A paedophile who set up fake accounts and thought he was grooming two young girls, sending them explicit messages, was jailed today.

However Arron Butler was in fact talking to a paedophile hunter and an undercover police officer, who were posing as underage teenage females, Mold Crown Court heard.

The 35-year-old of Cheriton Close, Connah’s Quay, Flintshire, admitted three charges – one of inciting a child to commit sexual activity and two of causing a child to watch a sexual act.

A fourth charge of attempting to engage with a child in a sexually explicit conversation, was allowed to lie on file.

Although there was no victim, Butler was sentenced to 20 months in prison today by Judge Niclas Parry.

Prosecutiing, Simon Rogers, said Butler had set up a fake account of a woman running a modelling agency, to target his first 14-year-old “victim” in 2018.

He sent explicit messages and images and put pressure on the victim to supply photos, but it turned out to be a paedophile hunter.

The police were called and Butler was arrested.

Mr Rogers said he appeared before magistrates in Mold in June this year and was committed to the Crown Court for sentencing.

However just 10 days after that, he contacted another 13-year-old “victim”, with a different fake account, where he used a photo of an ex-partner and daughter.

Butler again sent explicit messages, encouraging her to send a photo and perform sex acts, but this time it turned out to be an undercover cop and he was arrested again.

Butler was also made the subject of a sexual harm prevention order for 10 years, prohibiting him from contacting girls aged under, 16 unless under strict conditions.

He is also bared from deleting history and must tell the authorities if he changes any communication devices.

He was also given a restraining order not to contact his former partner for five years.
