Kelso child sexual abuse images offender given two-year supervision order

A 56-year-old man has been given a two-year supervision order at Jedburgh Sheriff Court for possession of scores of indecent photographs and films of children.

James Thomson pleaded guilty to committing that offence at a house at the Linn in Kelso between September 2015 and November 30 last year.

Some of the images and films uploaded onto his computer were in the most serious category A, showing girls aged from infancy to 12 years old engaged in penetrative sexual activity with adults or other children.

The court heard that Thomson, now living in Eyemouth, has been ostracised by his family as a result of the offence.

He was also placed on the sex offenders’ register for the next two years.

Thomson was told that one of the conditions of his community payback order is that he must make any internet device he uses available for inspection by police or social workers if requested.

32-year-old guilty of possessing indecent child images

A BERWICKSHIRE man has been ordered to carry out 250 hours of unpaid work for possessing indecent photographs of children.

Graham Whitson had denied the offence at a property in Glebe Park, Duns, on September 20, 2016.

But the 32-year-old, who gave an address in the village of Burnmouth, was found guilty following a trial.

Defence lawyer Stephanie Clinkscale said her client had lost his job as a result of the offence but was hoping to start his own welding business.

In addition to the unpaid work to be carried out within a nine month period, Whitson was also placed on supervision for one year and placed on the Sex Offenders Register for a year.

Borders man found guilty of possessing indecent images of children

A Berwickshire man has been found guilty at Selkirk Sheriff Court of possessing indecent photographs of children.

Graham Whitson had denied the offence at a property in Glebe Park, Duns, on September 20, 2016.

But the 32-year-old, who gave an address in the village of Burnmouth, was found guilty following a part-heard trial which concluded this week.

Sentence has been deferred until June 18 for the production of background reports.

21-year-old caught again with disturbing sexual images

A 21-year-old man who was found for a second time with indecent sexual images will be sentenced at Selkirk Sheriff Court next month.

Daniel Mark from Eyemouth already had a previous conviction for possessing indecent images of children for which he was given a three year Community Pay Back Order.

He pleaded guilty to another charge of having indecent images on his phone at his Killiesgreen home last June.

The court heard that three movies and seven extreme images were discovered – featuring a dog performing oral sex on a woman.

Sheriff Peter Paterson said it was a serious offence which would undoubtedly attract a custodial sentence.

But he added he wanted to consider a full range of background reports before sentencing pointing out Mark’s immaturity and vulnerability as well as his age in light of recent Appeal Court judgements.

Sentence was deferred until June 18.

Graduate to pay £1,000 after sexual advances towards 15-year-old in Gala supermarket

A UNIVERSITY graduate who made comments of a sexual nature to a 15-year-old girl in a Galashiels superstore has been ordered to pay a total of £1,000 at Selkirk Sheriff Court.

Twenty four year old Mohammed Pervez – who is now studying for a textiles doctorate at Heriot Watt University in Galashiels – was found guilty after a trial of the offence which happened in the Asda store in Currie Road on December 16.

During the trial the girl told how Pervez engaged in a conversation with her in the store and asked her questions such as did she have a boyfriend, would she go back to his flat with him, would she like to have sex with him and would she like to use a condom.

After hearing what Pervez was saying the teenager ran off and told her mother what had been said.

Pervez of Sime Place, Galashiels, told the trial he thought the girl was 18 years old.

Defence lawyer Ross Dow said it was a bizarre set of circumstances.

But his client accepted he should not be approaching anyone and having a similar discussion, let alone someone of this age.

Sheriff Derrick McIntyre fined Pervey £750 and ordered that he should pay £250 in compensation to the schoolgirl.

Eyemouth sex offender Robert Edwards left in charge of baby

A sex offender banned from having any contact with children was left alone in charge of a one-year-old baby, a court has heard.

Robert Edwards, 62, of Eyemouth, admitted breaching the terms of his Sexual Offences Prevention Order.

He had only been released from prison a few days earlier when he was left in charge of the child in Jedburgh on Wednesday.

He was jailed for 200 days at Selkirk Sheriff Court.

The court heard how he had been invited to stay at the home of a friend in Jedburgh shortly after his release from prison.

Procurator fiscal Graham Fraser said his friend and another woman, who had the child with her, had then decided to go to Hawick leaving Edwards with the infant.

He added that it appeared the baby’s mother had been unaware that Edwards was a sex offender.

Mr Fraser described the offence as a “spectacular” breach of the order and said it was concerning as Edwards had a previous conviction for assaulting a child of a similar age.

Social workers were tipped off that he was alone in the house with the child and the police were called.

Defence lawyer Fiona Hamilton said the child was meant to be watched by a neighbour who was unable to do so.

She said Edwards thought the two women were only going to a nearby shop for 20 minutes and was unaware they had gone to Hawick.

Ms Hamilton said he had tried to comply with the order and there was no planning involved in being in contact with the child.

She added: “He did not want to say no.”

Sheriff Peter Paterson jailed him for 80 days and added another 120 days for an unexpired part of his previous prison sentence after being released early.

Earlier this year Edwards was jailed for 12 months after a jury at Selkirk Sheriff Court convicted him of speaking to two children aged five and two at a bus stop.

Then, on a bus journey between Berwick and Eyemouth, he also offered them money and sweets – which breached the terms of his Sexual Offences Prevention Order.
